Terms of Service for Hidden Hug

      elcome to Hidden Hug (“we,” “our,” or “us”). By accessing or using our platform, creating an account, or sending messages and gift cards via our services (“Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms establish the rules and responsibilities governing your use of Hidden Hug.

If you do not agree to these Terms, you may not use our Services. 

1. Overview of Services

Hidden Hug provides a platform to send anonymous messages (“Messages”) and, optionally, gift cards to recipients. Users must create an account to access the Services, ensuring compliance with fraud prevention measures and accountability.

2. Eligibility to Use the Services

By accessing or using Hidden Hug, you confirm:

  1. You are at least 18 years old (or the age of majority in your jurisdiction).

  2. You have the legal capacity to enter into this agreement.

  3. All information you provide during account creation is accurate, complete, and up-to-date.

3. Account Creation and User Responsibilities

3.1 Creating an Account

To use our Services, you must create an account and provide the following information:

  1. Full Name; 

  2. Email Address;

  3. Phone Number;

  4. Residential Address; (including street address, city, state, and ZIP code, to confirm you reside in the United States).

  5. Payment Information; (valid U.S.-based credit or debit card).

 

U.S.-Only Policy:

  • Hidden Hug operates exclusively in the United States. By creating an account, you confirm that you reside in the United States and that all payment methods provided are U.S.-based.

  • Accounts or transactions originating outside the United States may be rejected or flagged for review.

Verification and Compliance:

  • We reserve the right to verify your address or additional identifying information to ensure compliance with our U.S.-only policy and prevent fraudulent activities.

  • Failure to provide accurate information may result in suspension or termination of your account.

3.2 User Responsibilities

By using Hidden Hug, you agree that you:

  • Will not use the platform to engage in illegal, abusive, or harmful behavior.

  • Are solely responsible for all activity under your account, including the content of Messages and gift card transactions.

  • Will promptly notify us of any unauthorized use of your account.

3.3 Recipient Consent and Communication Authorization

The Customer represents and warrants that they have obtained explicit permission from each recipient to receive text messages or any other communications facilitated through our service. By using this service, the Customer agrees to ensure that all provided contact information has been lawfully collected and that any communications sent to recipients are fully compliant with applicable laws and regulations. The Customer accepts sole responsibility for any claims, damages, or legal actions that may arise from sending communications without proper consent.

4. User-Generated Content

4.1 Messages Sent Through Hidden Hug

You are solely responsible for the content of Messages you send. You agree that your Messages will not contain:

  1. Threats, harassment, slurs, profanity, or hate speech.

  2. Any content that promotes illegal activities.

  3. False, misleading, or defamatory statements.

Hidden Hug may, at its sole discretion, monitor, delete, or block any Messages deemed harmful, inappropriate, or in violation of these Terms.

5. Anti-Money Laundering and Fraud Prevention

5.1 Data Collection for Compliance

To minimize money laundering and fraudulent activities, you agree that:

Hidden Hug will collect and store your identifying information, including but not limited to your name, email, phone number, IP address, and payment details.

We reserve the right to limit transactions or request additional identity verification for suspicious accounts or activities.

5.2 Transaction Caps

To reduce misuse, Hidden Hug enforces the following transaction limits for gift cards:

Daily gift card cap: $25

Monthly gift card cap: $100

6. Payment Terms

6.1 Payment Processing

All payments are processed securely through Stripe, a third-party payment provider. By using Hidden Hug, you also agree to comply with Stripe’s Terms of Service.

6.2 Refunds and Disputes

  • Payments are non-refundable, except as required by law.

  • Any chargebacks or payment disputes may result in your account being suspended until resolved.

7. Privacy Policy

We are committed to protecting your privacy. Please see our Privacy Policy for details on:

Data we collect (e.g., names, emails, payment details).

How we use your information (e.g., fraud prevention, service delivery).

Data retention and deletion policies.

By using Hidden Hug, you consent to the collection and use of your personal data as described in the Privacy Policy.

8. Data Security and Liability

8.1 Our Security Measures

  • Hidden Hug employs industry-standard encryption and security protocols to protect your personal information.

  • While we strive to protect your data, no method of transmission over the Internet is 100% secure. You acknowledge that you provide information at your own risk.

 

8.2 Your Responsibilities

  • You are responsible for keeping your account and payment information secure.

  • Hidden Hug is not liable for unauthorized access to your account caused by your failure to secure your login credentials.

9. Reporting Abuse or Harmful Messages

If you receive a harmful or inappropriate Message, you can report it to [insert contact email or reporting link]. Hidden Hug reserves the right to investigate and take appropriate action, including suspending the sender’s account.

10. Disclaimers of Warranties

Hidden Hug provides the Services “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to:

  • The accuracy, reliability, or timeliness of the Services.

  • The successful delivery of Messages or gift cards.

11. Limitation of Liability

To the fullest extent permitted by law, Hidden Hug is not liable for:

  1. Indirect, incidental, or consequential damages arising from your use of the Services.

  2. Harm caused by inappropriate Messages sent through the platform.

  3. Losses related to gift card transactions, including non-redemption or fraud.

12. Termination of Services

Hidden Hug reserves the right to suspend or terminate accounts for violations of these Terms, suspected fraudulent activity, or harmful behavior.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States. All disputes shall be resolved exclusively in the courts located in state or federal courts located in New Jersey.
